Ma. prenups have (within last few years) been judged as "not illegal" by MA SJC. Prior to that they where not binding in any way --- just ignored.

AFAIK, they are still not 'enforceable' as they may be elsewhere. But then in MA probate courts, all things seem matters of 'common law' --- and you can find precedent for whatever you please. Judge decides all.
