Well the tricks are out of the box and if Kerry does win, I hope they filibuster all liberal nominees. The differences today aren't in the confirmation percentage, its the percentage that actually received up down votes in the Senate after clearing the Judiciary Committee. Not allowing up down votes after clearning Committee via filibuster was a first in the Nation's history. The Senate is also a poor representation of State interests and its also a poor representation of individual interests. The State Legislatures used to select Senators. Now the meager population of Rhode Island gets the same say as California.
