I agree with your take. It's not nice to fool with the Feds much less the FBI. This is the more serious charge.

Still, it makes me wonder why Byron bothered to segue into the issue of the Feds possible prosecution of Elgindy on the publication of the alleged illegally obtained information. In comparison it seems like a small matter. Like it or not, I think the Feds are pretty much forced to get into that issue. It pertains to the substance of motive in the more serious charge.
