I think the proof for many clearly exists (take the link I cited earlier in this thread where one had been released only to return to Pakistan as a terrorist). Some who are totally innocent may be detained, I think that's likely. Unfortunately, this is a necessary evil, and a tolerable one, IMO.

If proof of the connection exists, I'm pretty sure the US has laws which have the punishment be execution by legal injection following conviction in the trial.

Where's the trial?? Maybe there's not enough proof. Maybe there's none.


Perhaps a trial isn't what's needed. Perhaps there is evidence these people are dangerous, but not enough evidence to convict in a trial.

People have to get past the "proof beyond a reasonable doubt" standard used in the United States criminal trials, and apply something more lax, like, for example, the "more likely than not" standard applied in civil proceedings. If these people could be brought to trial under such lesser standard, fine -- but then, you have the risk that innocents will be permanently branded a terrorist.

There is about choosing the lesser of two evils. There can be legitimate differences of opinion about which is the right choice. In my mind, if these people are "more likely than not" terrorists, it is okay to detain them without due process for a while.

I know you don't agree with the characterization, but this is, in fact, a "war", and we have to act like it.
