You appear to be confused.

I refer you again to the Times article I posted... which clearly references the fact that this latest batch of documents was produced consequently to the AP lawsuit (which I had previously referred to.)

...went through Texas files under an agreement between the Texas National Guard and The Associated Press, which sued to gain access to the papers.
