It would be fair in his/her opinion if he/she spoke with sincerity. Such a belief in fairness certainly existed in primitive times where those outside of family and tribe were considered to be creatures without rights.

Such opinions, however, are not held by rational people whom see color or gender--not as a "sin"--but as a characteristic.

The practice has evolved in western culture (as it has moved out of the age of superstition and over into the age of reason) to allow the accused the right to have his/her case "argued" by a trained rationalist and then rationally considered by 12 independent citizens--as far as is possible, without regard to prejudice and bias--but relying solely on reason and facts.

Contrast this with the invented God of an ancient and superstitious people--a God who became the reified embodiment of all their prejudices and superstitions, and who championed their barbaric conceptions of "justice".

In the modern age, We The People hold our judges to a higher standard of justice than the capricious exercise of prejudice and hate--although it is well recognised that human society is far from being wise. Indeed, in relative terms, it may truthfully be averred that we, too, are primitive...
