Bull Derrick, re: The concept of separation of church and state is not a constitutional right. In fact, it's not to be found in the Constitution anywhere.

Read the "establishment" clause of the constitution.

As for your other point, the courts and our founding fathers clearly understood that some of our rights were too important to be left to the protections of our legislative and executive branches of government. That's why we have "constitutionally protected rights." If those rights are to be limited the legislature must show a compelling state interest and that no less intrusive means of achieving that interest is available.

You may not like it but that's the way it has worked.
