I appreciate the effort you put in and found me the entire text of Brown vs. BoE, but what made you think I have not read the Declaration of Independence or the Constitution? I have read both of them many times and while I am not among those who have an almost religious awe for these documents or find the founding fathers almost infallible, I find them remarkable documents. More importantly I overwhelmingly agree with the ideals described within them.

Now you are right that I am not a lawyer. But having watched many years of Law & Order <vbg> I'd like to think I am not empty minded either :^) (Actually my father was trial lawyer before changing careers and we got to have many interesting debates at home) It is a fact that when faced with a challenging case, judges consult various texts, including foreign legal precedents if they have to. So if foreign legal opinions can be a factor, then why not the Declaration? One of the chief considerations before a judge is the intent of the legislature. So if one is to interpret the constitution, how can the ideals described in the Declaration be completely ignored? That just doesn't make sense.
