There was nothing in the Constitution in 1861 either, was there? HOWEVER, the USSC has since ruled that secession is illegal. The question of leaving the Union is not addressed by the Constitution. In Texas v. White (1869), however, the Supreme Court ruled that states could not unilaterally secede from the Union.
