I don't think that answers the question. Of course privacy, if it exists, can be set aside as you say. If there's a good enough reason. Which leaves only the question of what is a good enough reason. If it doesn't exist, however, there is nothing to set aside and no law is too intrusive. So the question remains as to whether there's a right of privacy.
