No, the right to privacy is not a "trump right" requiring strict scrutiny before it can be tampered with, unlike, for example, the right to free speech, which must show compelling state interest to be litigated. No, definitely not a trump right, but a right. Which means that there is some process and some standard to apply when intruding on it. No, not as tough a standard as the right to free speech, but some standard. The threshold of which is as yet not fully clarified--still a work in progress.
