People rarely, if ever, pay attention to state court judges' records, let alone connect the dots on election day. It takes an egregious and highly publicized ruling to get the public's attention at all.

If your jurisdiction elects its judges, go to your Board of Elections website and look at the election results from last Tuesday. I'll bet dollars to doughnuts that the number of votes cast for judge was disproportionately low compared to those of almost any other office or ballot question. People don't know the judicial candidates, their records, or what they stand for, so they don't cast a vote for judge.

Ironically, that choice can affect our society in a much more profound and long-lasting way than elections for legislative and executive positions, which are for a much shorter period and don't have the final say in interpreting the law.
