Toshiba sues Hynix in Japan and US over memory patents

Press release; Jack Lu, DigiTimes.com [Tuesday 9 November 2004]

Toshiba announced it is suing Hynix Semiconductor, both in Japan and the US, for infringement of Toshiba’s memory patents.

On November 8, Japan time, Toshiba filed suit against Hynix in the Tokyo District Court for infringement of three of Toshiba’s NAND-flash memory patents. On November 9, Japan time, Toshiba also filed suit against Hynix in the US District Court for the Northern District of Texas, for infringement of three DRAM and four NAND-flash patents. Toshiba said it is seeking damages against Hynix in both cases.

Toshiba claimed it was “left with no alternative other than to pursue legal recourse” against Hynix because the two firms could not agree on fees Hynix should pay for accessing Toshiba’s patents.

Toshiba’s suit against Hynix follows two August 18 suits filed by SanDisk against STMicroelectronics. SanDisk claims ST infringed SanDisk’s NAND-flash patents.

Toshiba and SanDisk are technology partners on NAND flash. Hynix and ST also have a similar relationship.

Wonder how Sndk is doing? I ordered a 1GB Cruzer Mini from Dell for $51 AR sometime ago and they still haven't shipped it. Dell reports it is getting built and still doesn't have a date yet! I think, the rebate expires 11/27. Anyone else got it?
