I just don't think that the court should invent ideas to put in to the constitution to try and expand that protection. The constitution itself provides a lot of protection. It can be extended by amendment or we can vote out the louts who don't give us protections that we want. Either one of those is preferable to 9 men and women sitting on a bench and making law for the country that has no appeal other than by amendment.

If they can invent things for causes you like they can also invent things that oppose liberty or that you would dislike for other reasons.
