Pluvia, it looks like we are both miss-reading each other. I don't think there is any need for a defense of Mr. Elgindy's site members, and the indictment support that. I never implied otherwise.

If I agree with you on that the AUSA has charged more than he thinks he can prove, I would then have to agree that everyone possible to be charged....has been charged. My first posting was basically trying to say stop the grand theories, and look at what is actually going on.

If you look at the section of the indictment I posted, you would see that the charges against Mr. Elgindy are fairly basic. The evidence is fairly clear. If you read just the information on Company #1, there is nothing I have seen in Mr. Elgindy's posts here, the legal papers he posted, that makes me think he defense team understands what is being alleged.

Mr. Elgindy's defenses and defenders have raised the prospect that he was outing companies with bad management and therefore helping individual investors. Great! But that has NOTHING to do with what he is being charged with. It might be a good argument if he is convicted and wanted a lesser sentence. But raising it as a defense now, is foolish.

Its a "yes, however.." defense
The "however" part is not important. The law stops after hearing "Yes"

It comes down to simply what Mr. Elgindy did. There are concrete actions which are documented in the indictment;if they are not denied, with credibility, the outcome is not a hard guess for this trial.
