the point is funds can't invest in commodities, futures, etc. They CAN buy stocks

Haven't we just gone a full circle? That was my point to start with... Why was the SEC and NYSE giving us the excuse that we couldn't have a gold ETF in the proposed form because the pension funds can't invest in commodities!

That's exactly the same as telling all retail shops they can't stock cigarettes because minors might buy them, therefore nobody should be able to buy. (Not that I wouldn't be in favour of that rule on cigarettes) ;-)
