I'm aware that there is no need to bring it to the court. Also the only source that I've seen that says conservatives will try to bring it to the Court is Kinsley so I wouldn't be surprised if he was wrong, however IF they did bring it to the court and the court went along with it then you would have a strong case of judicial activism.
