The footage showed several Marines with a group of prisoners who were either lying on the floor or propped against a wall of the bombed-out building. One Marine can be heard declaring that one of the prisoners was faking his injuries.

"He's fucking faking he's dead. He faking he's fucking dead," says the Marine. At that point a clatter of gunfire can be heard as one of the Marines shoots the prisoner. Another voice can then be heard saying: "He's dead now."


If the Marine in question knew that the captured wounded insurgents where captured and disarmed than this was murder, both an ordinary crime and because of the circumstances a "war crime". If OTOH he had no such knowledge, and he initially thought that the insurgents in the room were dead, and than saw one of them move and thought that the insurgents where faking their death so that they could blow up marines (and themselves) when the Marines got close than his actions make some sense.

We can't of course read his mind but it should be possible for an investigation to flesh out the details of the situation. If it was a murder he should be prosecuted, convicted, and punished like any other murderer.
