Thanks for finding that. I had read it previously, and it was a factor in my making the comment. There is a certain amount of determination, which can be made without much effort.

Does the enemy military identification? Is the combatant wearing the uniform of a state? If no to both, then they can reasonably be determined to be an enemy combatant, and subject to tribunal review.
