There are risks in acknowledging the discrepancy but there are also risks of the press operating off one standard and the military and the administration operating off another.

"Private Ryan" and "Band of Brothers" both explored this "shooting prisoners" problem. The most common example happens is "heat of battle." This one was on the edge of a "HOB" situation. The classic one is when someone you are fighting stands up and surrenders and you kill him anyway. This one is never prosecuted. The second one is when you accept the surrender and kill him shortly thereafter. This one is a close call, and will depend on witnesses. The third one is the cold blooded killing of prisoners later than say, 10 minutes after capture. If witnessed, it is always prosecuted.

All of these are judgement calls with no firm rules. A common sense situation. The one we are discussing is political, because of the film of the situation. The closest example we get of this is the LA Cop beatings that were filmed.
