Were the combatant's hands above his head and behind his head? The fliers told them for months that's how they were to surrender. Also, the citizens of Fallujah were warned for a couple of months to leave the town. 200-300,000 of the citizens did leave. Why didn't these combatants leave? By not leaving, they were legally combatants. Why didn't Sites turn the guy over to determine if he had a bomb strapped to his chest? Or a grenade in his hand?
