Most intelligent employers hire an attorney to advise them how to lay off people. The notes from the conversation are not likely subject to subpena. The payables records might be. The bills for the conversation(s) might reveal interesting timing.

The truth may be stranger than fiction.

The possibility of payback for spreading the truth exists. It is also possible that the decision was one that was only related to a decline in business.

I have observed companies lay off regional staff only to advertise for the replacements when business recovers. Of course this may just be a plausible sounding explanation to cover their buts for a political hit.
