They need to include some way of discouraging business as usual or the proposed program won't have the desired effect.

It's not totally unreasonable to consider that the desired effect actually is to make a show of tolerance, while leaving the government with additional basis for prosecuting the illegals, by simultaneously creating and disincentivizing compliance with an amnesty program.
