I don't agree. Freedom to be an athiest is your right as much as freedom to be a Christian is my right. You don't have a more fundamental right to believe your beliefs than I do mine. If you did, then that would be unfair.

Our founding precepts were created to ensure among other things freedom OF religion. Part of that is your choice to believe in nothing. However, none of our founding documents said that our country and its government HAD to be completely free of all religious connections.

For instance, if our government is allowed to fund a secular charity, it should also be allowed to fund a faith-based charity. To prohibit that would be discrimination against religion, plain and simple. And that IS against the law.
