Assuming NTP has a rational management (and not one meddling from the land of the dead) looking to maximize profits, they will move in the direction of collecting royalties from RIM. Injunction is the threat to bring RIM to choking up royalty payments to NTP.

Having said that, the 8.55% proposed royalties reduce RIM's expected EPS by 20% and with that consideration I have been short the stock for a while and look to profit handsomely from its losing legal battles.
