You left out negligence, which comes under "do unto others, turn your corners at right angles, cross your t's, dot your i's".
It's true that there are completely frivolous lawsuits filed, but not common for them to go to the jury, because judges are not dummies. And there are appellate courts to fix errors in trial courts.
Take, as an example, the famous McDonald's hot coffee case. What you never read about is that the evidence given to the jury was that McDonald's had received hundreds, maybe thousands, of complaints that customers had received serious burns from the coffee. This wasn't just a one time incident. That's why the jury awarded punitive damages -- which, by the way, were greatly reduced on appeal, which is also something you never read.
If you sold coffee for a living, and your customers kept telling you that the coffee was so hot that it scalded them and caused second degree burns, would you listen to them? |
