One of my husband's first cases as a young lawyer was an appeal on a case where a magazine had been sued by a restaurant after a food critic used the word "execrable" in his review. The restaurant said people confused it with excrement. A jury had agreed. He won the appeal in front of a judge, who was-- apparently-- somewhat more erudite.
