U.S. Supreme Court Lets Massachusetts Gay Marriage Law Stand



The United States Supreme Court refused to hear a case involving the legality of a Massachusetts' law sanctioning gay marriage. A challenge had been issued to the law by conservative groups but the court declined to hear the case without issuing any comment.

The conservative activist group, the Liberty Counsel, believed that the federal government should step in and 'protect the citizens of Massachusetts from their own state supreme court's usurpation of power,' according to Mathew Staver, their attorney on the case. He claimed that the Massachusetts Supreme Court's decision upholding gay marriage was a form of tyranny against the people of the state.

Massachusetts attorneys argued that the group filing the suit had failed to show they were an injured party under the decision. 'Deeply felt interest in the outcome of a case does not constitute an actual injury,' said Merita Hopkins, a city attorney in Boston.

A possible amendment to the state constitution will likely be on the ballot in 2006 which would allow gay civil unions but not allow gays to 'marry.' This will give the voters a chance to have their say on the matter, according to Massachusetts Attorney General Tom Reilly.

This is the second time the U.S. Supereme Court declined to hear a case on the Massachusetts gay marriage issue. In May, the court refused to block Massachusetts court clerks from issuing marriage licenses to gay couples.
