Tom, great post. I personally will bet dollars to doughnuts that this never sees the inside of a courtroom. A discovery process alone would be enough to freak out any of the "anti-protagonists"(new cyber free speech word, like in anti-hero). The idea of a cyber patrol is one of the funniest I've heard yet. Are they going to write a search engine that looks for every mention of the words 'double' 'ten-bagger' 'big gains' etc, etc. They'd get a return that listed 5 billion pieces of spam mail!!!!! More likely they'd use some low-tech solution like following only the boards of the companies that pay them. Then what if they find a negative post, but the poster uses his real name and says he's short the bejeezus out ot the company? Having had fun making fun of both sides, I'm still wondering how to address the real and continuing problem of false statements, whether bullish or bearish. I love to hear both sides, opinions or facts, doesn't matter. Even scarier is reading a post that later proves to have been inside info from an anonymous source. This is really disturbing. How do we identify that these posts are the real deal in time to make money from them?
