I've often wondered whether 10b-5 and other regs might be applied to those who act like analysts, (whether they be touts or bashers), with the distribution channel, as you detail, being pertinent to both a determination of manipulative behavior and also possible damages.

As you suggest - if someone can act like an analyst, send a home grown PR to BW with a check, there has to be some ramification. If it comes across a quote streamer or Yahoo, most, I fear would think there is some real significance to that.
