Seems to me the key issue will be whether Royer really had carte blanche to hand out classified information at his own discretion or not. Then, did Royer have a two-way financial relationship that flowed from confidential information, whether he was allowed to use it at his own discretion or not.

If the prosecution can connect all the dots in their case, the only tactic left for their defense is the "well it was legal anyway" theme or the even lamer "well we thought it was OK even if it wasn't".

The only opinion that natters there is the jury's.
