You miss the big point ie torture can be justified in some circumstances. That makes us bad guys. The bigger problem is that he believes the president doesn't have to 0bey a law he thinks is unconstitutional. Its the job of the judiciary to make such decisions not the executive branch and thus strikes right at the heart of our democracy by ignoring the checks and balances built in to our system of government. That added to his embrace of killing and torture makes him totally unfit for government service. Its sick to argue when torture might be legal or when arrest and confinement without due process might be legal shows just how debased the Bush team has become. This is the realization of the worst fears of the bush haters and I am shocked that so many as yourself don't see the implications of what is at stake.
