The standard in intelligence is not "prosecutorial", that is, one does not have to prove beyond a reasonable doubt. Indeed, it is irresponsible to hold intelligence to the stricter standard. We are trying to defend our interests, not assess penalties in a criminal trial. It can be argued that, in the wake of 9/11, the US intelligence community was loathe to let any apparent threat go uncommented on, but that is about it.
