It would appear there was no judicial review of FDR's Executive Order regarding the German Saboteurs. FDR appears to have personally declared them illegal combatants. Here I think Bush has looked at the evidence and declared all detainees illegal combatants. Blame FDR not Bush for creating and setting the precedent.
