Jeff,

If the jury finds fault with the FBI but views Tony as having no illegal intent, then also finds no extortion, would erasing the logs continue to be an offense since effectively there would be nothing to hide?

I'm not saying this will happen, but is an interesting twist similar to Martha Stewart's case where all they had was lying to the feds about an event no longer viewed as a crime.
