There is no user agreement and never was, to my knowledge. There is a Terms of Use by which the user agrees to the conditions for using the site. That said, the current owners did indeed grandfather the status of heritage users to the extent described in the feature list.

The Terms Of Use has always has the equivalent of "subject to availability" clause (my terminology), currently Section 6 of the TOU.

I don't recall there ever being such a clause. Can you cite one... or were you just asking if such a clause exists?
