IF AP:

1. front-ran his own members or covered into short calls; and
2. traded on non-public FBI info when no one else had that luxury; and
3. conspired with others to drive down prices so stocks he attacked would tank in no time leaving investors with enormous losses; and
4. claimed all over the Net that he was a scam-buster while at the same time extorting free shares from the companies he attacked through the RICO enterprise, and then covered without informing members who paid him for advice, let alone SI members; and
5. destroyed evidence related to his case, for example the chat logs, why Hansen pleaded guilty

then I think calling AP an "underdog" is incredible. I'd say AUSA was the real underdog here, considering the scope of the alleged deception, and the levers of power deployed here and via the Internet to cover tracks. Also underdogs were traders trying to do honest research, and members who trusted AP, who never had a chance - unless they were engaged in the enterprise, small ring of traders in that position, trading against volume created at the site and SI.
