i think you're mixing your apples and oranges. blodgett etc made rec's that they themselves AT THAT VERY TIME did not believe. clearly a problem.

in the elgindy case, the jury instructions suggest the gov is trying to say a person who takes a position then disseminates any information, DD etc - EVEN IF AVAILABLE PUBLICLY, is trading on inside information and the dissemination is an act of manipulation.

apples and oranges with blodgett et al. .... if true, a seemingly big problem for anyone doing DD and publishing anywhere, including the net. that's a big chunk of wallstreet.

Blodgett, the MerrilLynch crew, Leded, etc., all IMO should face the music of 10b-5 and other regs and statutes. If a tout is selling into his recommendations, I personally believe that this is manipulative behavior and hope that the SEC goes after them.
