I don't see why anyone couldn't trade based on your scenario.

I don't see the question as particularly material to the fact pattern of the trial.

Now, if you are considered an analyst or a financial adviser, (as defined and interpreted under SEC acts and regs) and you don't disclose to your disciples before publishing a report, or if you then trade in opposition to your publication, then those are quite different questions.
