Q Okay. And in this -- in this first phone call, there was a discussion regarding Mr. Emschwiller and his book?
A No, the first conversation was Richard Marchese calling me up to inform me that he was pissed off because I had confused him with Rick Marcasse, that Marcassi was the guy shorting Amazon and that he had nothing to do with Amazon, and -- but he did know Jeffrey Mitchell and Janice Shell and he could shut them up. I said -- well, you know -- I won't guess at what I said what I do know I said was this. He told me that Jeffrey Mitchell and Janice Shell could be shut up by him. He said I confused -- I confused Rick Marchese with Rick Marcassi and channel she will and Jeffrey Mitchell were paste posting at the same
19 time he wanted me to know that I was very upset and didn't want me to post another word about him and his involvement with Amazon natural treasures.
Q What was your response?
A I said, hey, man -- whatever you say. We'll go -- I'll go do the -- I'll go do the diligence and see if find a Rick Marcassi. And I couldn't find a Rick Marcasse anywhere.
Q And this initial phone call, did he threaten you in any way?
A No, he didn't threaten me in that phone call.
Q Okay when was the next communication you had with anyone in -- identifying themselves as Richard Marchese?
A I don't remember the exact dates but -- I don't remember the exact dates. I remember more the topic matter, and subject matters but I don't remember the exact dates. It was all around the time -- you know -- yeah, I remember the same time he was calling me, shell and Mitchell were working on the threads publicly. So it was like a group gang bang on me publicly so the way I can tell you the dates of phone calls when shell's posting about the phone calls online. I mean I can go back and find the dates of everything because whatever shell's posting Marchese is calling me about.
MR. RICHTER: I just -- just a little aesthetic comment. I mean if you are tired and want to take a break.

Q I'm trying to find out what the next conversation after your first conversation was. Was it the March 27th conversation, was that the next conversation?
A No. No, the conversations -- and the instant messages he also sending me instant messages and instant messages by the way jibe with the stuff he's
19 telling me on the phone so there's no Dante. It is Marchese talking to me. He's telling me the same enough in the instant messages as on the phone. The context of the call, the first call had to do with this Rick Marcassi. He wanted me to know that Rick Marcasse and he spelled it for me was shorting Amazon, not him. He had nothing to do with Amazon. And I had them confused and that he notified Janice Shell and Jeffrey Mitchell of this and that's why they were posting about it because he was very upset that somebody thought he was involved with the shorting of Amazon natural treasures. So that was the first conversation. That was the context, right? Later John Emschwiller was writing a book about stock manipulation on the Internet and he was looking into Rick Marchese, Rick Marcassi deal and he called me up wanting all the information I had because online, Janice, who originally was posting that Rick Marchese was shorting Amazon with Andy Mann changed her mind that it was Rick Marcasse. She talked to Rick Marchese, like he called me and Rick Marchese told Janice Shell, like he told me, that we had him all confused it was Rick Marcassi shorting Amazon and not him. Okay? So the second conversation that he called me up said he wanted me to know that his lawyer had researched John Emschwiller of the "Wall Street Journal" and he was a fraud. He wasn't a real reporter. He wasn't writing a book. His lawyer could contact me if he wanted me to. He could give me his lawyers number if he wanted me to and that the letter he sent January Embroiler was so grammatically poor that he wasn't a writer and would love at it. I told

John then called me and told me that someone calling themselves Rick Marcasse called him up yelling after he talked to Tony Marchese or something, you know, but -- you know, John -- you can read what John wrote about this in his book but the part that I remember is the conversation that Marchese telling me that Emschwiller was a fraud and, you know, could you talk to John about his part of it, but, you know, Marchese told me the same crap he told Emschwiller.
