OK, let's for the sake of argument assume as you propose that under the law there are different kinds of RICO conspirators, that some get a free pass if they violated the law because someone asked them to do it, as so many otherwise law-abiding citizens are wont to do when asked to commit multiple crimes. Are we to believe that an FBI agent with virtually nil trading experience concocted the trading and extortion scheme and then contacted Tony? Royer was the mastermind? "As for who sought whom is a question that probably wasn't that important. If you are part of an enterprise, it doesn't matter if you seek it or the other conspirators seek you." I think it makes an enormous difference.
