Furry,

If they argue that it is within their promotional activities that they try to verify the validity of all mining operations within the state then they must prove that they are capable and qualified to do that and there are no guidelines set forth that I have heard that give them any qualifications to do such. By undermining the company and taking samples from the surface with no regard to the R & D that IPM has performed to date would indicate to me that they are not qualified or responsible so I would think that the state would be best served to bow to the findings of BD. You know it's fun being an arm chair ambulance chaser.
