It sure does seem like a violation of freedom of speech to fire an employee for having a Kerry/Edwards bumper sticker on her car. That does not affect work performance in any way.

However, smoking does affect work performance. Smokers take more breaks during the day, which makes them less productive. And they take more sick days during the year. When you don't smoke and are never around smoke, the way smokers smell can be really overpowering in enclosed spaces like offices. And it seems like this employer gave very ample notice of the policy and tried to help his employees quit.

And here is a report from the Taipei Times about how antismoking legislation is sweeping the planet. Bhutan has outlawed all sales of cigarettes in the entire country, as well as outlawing smoking in all public places. The trend is moving seriously away from smoking, worldwide. I don't think it has registered yet with most people that Ireland, which used to be full of smokers, has outlawed smoking in bars as well as restaurants, as well as in company cars. The Europeans are deadly serious about their new health laws:
