Although it was hard to read certain sections on my friend's computer, it looks like CNN is saying it didn't make or publish anything so, therefore, how could it be liable.

One of the great problems with our court system and one cause of inefficiency and bloated backlogs is that cases like this can take up so much time and effort. Common sense would rule out something as laughable as requiring liability for not suing, or otherwise stopping, someone who uses a variant of one's name on a message board. Law must follow common sense to be viable, predictable and reasonably enforceable.

One other poster mentioned "sanctions." We need to impose stricter sanctions, including reasonable attorneys fees for the winner. "Anyone can sue," is a favorite expression in the US. If the loser were required to pay the winner's legal fees and costs, one would be more prudent before bringing frivolous cases and cases would settle more often and sooner.
