Hi Kevin. Of course you are always welcome to weigh into any discussion I am part of with your thoughtful contributions.

The observation that is being made is that 'it is wrong to attempt to legislate morality' as a common rap on republicans. The question I have raised and I don't believe you dealt with is, what do you mean by that.

You must scoop your side walk after an inch of snow has fallen or be given a ticket by the city I live in. The behavior that is good and right is 'scooping.' The behavior that is bad and wrong is 'not scooping.' This was determined after the law makers agreed that citizens are being harmed in relation to our conduct in regard to scooping.

There is a right and wrong behavior that is being legislated. Likewise we have legislated certain areas of murder and such to be bad with varying degrees of sanction depending on our angst about such an event. All laws have some basis in morality according to the premise I set.

"Any attempt to make a law that moralizes does so on very shaky legal ground."

You gave some excellent examples but I am not able to determine the line of distinction you are making here, except that you seem to believe that the Republicans do it wrongly. Could you clarify?
