I did some research and it looks like the issue has been addressed by at least one US court that has concluded Google's practice did not violate the federal trademark laws. Accordingly, I think an action would be an uphill battle. Here is a link to an article suggesting that Google will appeal smdailyjournal.org Here is a link to the U.S. Court action.
