You're right, that is just a definition that is dependent on the situation. There are many ways in which it is 'legal' or 'right' for one person to take another person's property. George Bush made his fortune in part due to the taking of personal property for his stadium. He made $14 million instead of going to jail.

I do not think there is an objective standard for anything. I'm not a fundamentalist either religious, cultural or legal. You can kill someone in 'war' and be considered a hero while in 'peace' you'd go to jail.

Morality and ethical behavior are situational and, frankly, largely dependent on how much power people have over others.
