I'll tell you though, if the SEC had set out as its goal to create a potential PR nightmare for itself, by taking a fairly common yet not-well-understood investing mechanic, couching it in terms that make it appear to be at the very least an impropriety ("failure to deliver"), and then leaving large segments of the investing public with the impression that it was a big problem that they (the SEC) either can't or won't do anything about, I can't offhand think of a better way to accomplish all that than they way they've handled these new shorting regulations.
