That's an interesting article, which covers many of the issues, including the fact that the consumer was forced to withdraw his claim for legal fees for fear of being countersued.

I'd like to see some type of small claims court or mandatory arbitration for internet defamation and related issues, particularly if it involves private individuals and small businesses. This would either have to be national or contractual through all ISP's, because of issues relating to jurisdiction.

I've seen web sites where disgruntled individuals, e.g., ex-spouses, patients unhappy with an otherwise fabulous doctor, etc., post defamatory material about others who have touched their lives. Most don't have the resources to fight this in court. Neither do they have the resources to start a competing web site.

Tough areas to regulate and legislate, particularly where free speech clashes with right to privacy and comes close to defamation.
