I'm actually trying not to argue theory. In reality, the cost of litigation is what prevents someone wronged from getting "justice," as that may be defined. You've heard, I'm sure, "you get as much justice as you can afford," cynical, yes, but accurate.

It's pretty much a waste of time to argue how high the bar should be if most of us can't afford to make sure the bar doesn't fall. Perhaps you and other diehards don't realize this because you have done so much pro bono or with assistance. (I'm not being critical, just expressing an opinion. In fact, I admire much of what crusaders do. OTOH I'm bottom line, practical and would prefer some concrete results.) Most of us out here don't have the time to devote a career to pro bono or the resources to enforce our rights, even if they exist with a high bar or a low bar.

That's why I suggested a national small claims or mandatory arbitration online panel. If there is a remedy that is practical, then we can spend time arguing how high the bar should be. <ggg>
